The Supreme Court will this morning deliver judgment in the appeal
filed against the election of Governor Theodore Orji of Abia State by a
chieftain of the Peoples Democratic Party (PDP) in the state, Chief
Ikechi Emenike.
Emenike had earlier approached a Federal High Court sitting in Abuja
to institute a suit based on section 87 [9] of the Electoral Act, 2010
(as amended) claiming that he and not Governor Orji was the rightful
standard bearer of the PDP to contest the April 16, 2011 governorship
election in the state.
He premised the suit on the ground that he was the duly elected
candidate at the appropriate primary conducted by the state congress of
Abia State on January 10, 2011 and that the incumbent governor was not a
member of the PDP at the material time and should never have been put
forward as the successful candidate at the primary.
The High Court ruled in favour of Orji but not satisfied, Emenike had
approached the Court of Appeal to challenge the decision of the lower
court.
The Court of Appeal, Abuja Division also upheld the ruling of the lower court.
Still not satisfied, Emenike headed for the apex court.
